Welcome to Lumi ("Company", "we", "our", "us"). These Terms and Conditions govern your use of our mobile application, Lumi (the "Service").
By accessing or using the Service, you confirm your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Lumi is a productivity and goal-tracking application powered by Artificial Intelligence. It allows users to set goals, track daily habits, and receive AI-generated suggestions ("Quests") to help them achieve those goals.
If you create an account in the App, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security.
We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of these Terms or that your conduct or content would tend to damage our reputation and goodwill.
You retain ownership of any data, text, or other materials you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, and process such content solely for the purpose of providing and improving the Service (e.g., generating your quests).
You agree not to submit content that is illegal, offensive, threatening, libelous, defamatory, pornographic, or otherwise objectionable.
Some parts of the Service are billed on a subscription basis ("Subscription(s)").
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Lumi and its licensors. The Service is protected by copyright, trademark, and other laws of both the country of origin and foreign countries.
Our Service may contain links to third-party web sites or services that are not owned or controlled by Lumi. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.
In no event shall Lumi, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
The Service is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
